Town of Wolfville Land Use By-law, April 18, 1996
5.1 Uses Considered by Development Agreements
The following developments shall be dealt with by Development Agreement, in accordance with the Planning Act, R.S.N.S. 1989, Chapter 346, and the Municipal Planning Strategy for the Town of Wolfville:
5.1.9 In the Residential Architectural Guidelines Control Area as shown on Schedule B, for:
construction of new residential buildings in excess of 95 square metres in total floor area;
additions to existing residential buildings that exceed ten percent (10%) of the existing building area, and that are visible from the street adjacent to the property;
construction of new accessory buildings in excess of 20 square metres in building area where the accessory building is visible from the street adjacent to the property;
additions to existing accessory buildings in excess of 10 square metres in building area, where the accessory building is visible from the street adjacent to the property (as stipulated by NIPS Residential Policy 24, section 3.5. 10).
For purposes of this Section, visible shall mean within clear site lines of less than 100 metres distance, not blocked by any building, from any point on the street or streets on which the subject property is located.Vegetation and fencing shall not be deemed to block the site lines.
5.2 Exemption
The Town of Wolfville shall be exempt from the requirement to enter into a development agreement under subsection 5. 1.
6.32 Residential Architectural Guidelines Control Area
In the Residential Architectural Guidelines Control Area the following special provisions shall apply in addition to the normal requirements of the zone:
a) Additions or alterations to buildings that are visible from the street adjacent to the property, shall use the same style of roof as that of the existing building.
b) Additions or alterations to buildings shall use the same style of windows and doors as those that predominate the existing house.
c) For purposes of this Part and Part 5, visible shall mean within clear site lines of less than 100 metres distance, not blocked by any building, from any point on the street or streets on which the subject property is located. Vegetation and fencing shall not be deemed to block the site lines.
